INFORMATION ABOUT LAW NO. 6698 ON THE PROTECTION OF PERSONAL DATA
Fluid Kontrol Automation Hydraulic Pneumatic Machinery Industry and Trade Limited Company, which adopts the principle of the rule of law, operates with a customer and human-centered good governance system and is conscious of its responsibilities regarding the privacy of private life and the protection of personal data under the relevant legislation.
In this regard, as the data controller in accordance with Law No. 6698 on the Protection of Personal Data, Fluid Kontrol Automation Hydraulic Pneumatic Machinery Industry and Trade Limited Company fulfills its obligations within the scope of this law.
RELATED LEGISLATION
The right to demand the protection of personal data is a constitutional right. In Article 20 titled 'Privacy of Private Life' of the 2709th Law of the Republic of Turkey Constitution:
Everyone has the right to demand respect for their private life and family life. The privacy of private life and family life shall not be violated (Third sentence repealed: 3/10/2001 - Law No. 4709/5, Article).
(Additional paragraph: 07/05/2010 - Law No. 5982, Article 2) Everyone has the right to demand the protection of their personal data relating to themselves. This right includes being informed about personal data concerning oneself, accessing this data, requesting the correction or deletion of this data, and learning whether this data is being used for its intended purposes. Personal data can only be processed in cases prescribed by the law or with the explicit consent of the individual. The principles and procedures regarding the protection of personal data are regulated by law.
As an addition to the relevant Article of the Constitution of the Republic of Turkey, the legislator has made regulations regarding the protection of personal data. In this regard, Law No. 6698 on the Protection of Personal Data was enacted and published in the Official Gazette numbered 29677 on 07.04.2016, and thus, it came into effect.
PROCESSING OF PERSONAL DATA
The processing of personal data according to Law No. 6698 refers to any kind of operation performed on personal data, whether fully or partially automated or through non-automated means as part of any data recording system. These operations include obtaining, recording, storing, preserving, modifying, reorganizing, disclosing, transferring, taking over, making the data available, classifying, or preventing the use of data.
The processing of personal data is possible if at least one of the situations listed in this Law's 5th article exists. Accordingly;
The explicit consent of the data subject,
• Clearly provided for by the laws,
• It is necessary for the protection of the life or bodily integrity of the data subject or someone else where the data subject is physically or legally incapable of giving consent,
• It is necessary for the establishment or performance of a contract and directly related to the parties of the contract,
• It is necessary for the data controller to fulfill its legal obligations,
• The data subject has made the personal data public themselves,
• It is necessary for the establishment, exercise, or protection of a right,
• It is necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.
THE PRINCIPLES ADOPTED FOR THE PROCESSING OF PERSONAL DATA
Your personal data is processed by Fluid Kontrol Automation Hydraulic Pneumatic Machinery Industry in accordance with Article 4 of Law No. 6698;
• Compliance with the law and principles of honesty,
• Being accurate and up-to-date when necessary,
• Processing for specific, explicit, and legitimate purposes,
• Being relevant, limited, and proportionate to the purposes for which they are processed,
• Being processed within the framework of the principles of retention period stipulated in the relevant legislation or necessary for the purposes of processing.
INFORMATION OBLIGATION
As the data controller, Fluid Kontrol Automation Hydraulic Pneumatic Machinery Industry is obliged, in accordance with Article 10 of Law No. 6698, to provide the following information to the data subject personally or through an authorized person during the collection of personal data:
• The identity of the data controller and, if any, its representative,
• The purpose for which personal data will be processed,
• To whom and for what purpose personal data can be transferred,
• The method and legal basis of collecting personal data,
• Other rights listed in Article 11.
When the obligation to inform will be fulfilled:
If personal data is obtained directly from the data subject; the notification is made at the time of obtaining personal data.
If personal data is not obtained directly from the data subject:
a) within a reasonable period from the time of obtaining personal data,
b) during the first communication if the personal data will be used to communicate with the data subject,
c) at the latest, during the first transfer of the personal data if they will be transferred to another recipient.
ENSURING THE SECURITY, STORAGE, AND ERASURE OF PERSONAL DATA
Fluid Kontrol Automation Hydraulic Pneumatic Machinery Industry takes all necessary technical and administrative measures to ensure an appropriate level of security in order to prevent the unlawful processing of personal data, prevent unauthorized access to personal data, and safeguard the storage of personal data in accordance with Article 12 of Law No. 6698 on data protection.
Even if personal data has been processed in accordance with the law, in case the reasons requiring its processing cease to exist, such data is being deleted, destroyed, or anonymized by the data controller Fluid Kontrol Automation Hydraulic Pneumatic Machinery Industry either ex officio or upon the request of the relevant individual.

f) Requesting the deletion or destruction of personal data within the framework of the conditions stipulated in Article 7 of the KVKK,
g) Objecting to the occurrence of a result against themselves, which arises solely from the analysis of processed data through automated systems,
ğ) Demanding the compensation for damages in case of suffering damages due to the unlawful processing of personal data.
As the data subject, you have the right to apply for your rights specified in Article 11 of the KVKK by submitting your applications to Fluid Kontrol Automation Hydraulic Pneumatic Machinery Industry through the communication channels specified below with information and documents to identify your identity. The requests included in the application will be concluded free of charge within thirty days at the latest, depending on the nature of the request. However, if the process also requires a cost, Fluid Kontrol Automation Hydraulic Pneumatic Machinery Industry will charge a fee according to the tariff determined by the Personal Data Protection Board.
